Meeting Notification: MGC to hold public meeting on December 16, 2021; Conference Call Available

WHO:                    Members of the Massachusetts Gaming Commission including Chair Cathy Judd-Stein and Commissioners Gayle Cameron, Brad Hill, and Eileen O’Brien

WHAT:                  The Massachusetts Gaming Commission will hold public meeting #363 on Thursday, December 16, 2021.

After the meeting is called to order, Executive Director Karen Wells will provide an administrative update, which will discuss the following:

  • On-site Casino Updates
  • Update of the Voluntary Self-Exclusion Program

Commissioner Cameron, Commissioner O’Brien, and Executive Director Wells will then lead a discussion related to the adoption of a flex and remote hybrid work model policy. A vote on this matter is anticipated.

Gaming Policy Advisory Committee Chair Meg Mainzer-Cohen, Commissioner Hill, Commissioner O’Brien, Director of Research and Responsible Gaming Mark Vander Linden, and Chief Administrative Officer to the Chair and Special Projects Manager Crystal Howard will provide an update on the GPAC and its subcommittees.

Director of Racing Dr. Alexandra Lightbown will ask that the Commission vote on Plainridge Park’s request for a revised 2022 racing schedule.

The Commission will then vote on the following requests from Suffolk Downs:

  • Request for 2021 Premium Free Period – VOTE
  • Request for 2022 Premium Free Period – VOTE
  • Request for Approval of Simulcast Import Locations – VOTE
  • Request for Approval of Account Wagering Providers – VOTE

Licensing Division Chief Nakisha Skinner will request Commission votes on the following:

  • MGM Springfield Service Employee Exemption Request
  • Encore Boston Harbor Gaming Beverage License Amendment

Community Affairs Division Chief Joe Delaney will discuss a request from the City of Everett related to the usage of Transportation Planning Grant funds.

General Counsel Todd Grossman and Associate General Counsel Carrie Torrisi will ask that the Commission vote on the following:

  • Final Draft of Amendments to 205 CMR 134.01: Key Gaming Employees and 205 CMR 134.02: Gaming Employees and Amended Small Business Impact Statement; Adopt and finalize the promulgation process – VOTE

The Commission will receive a legislative update from MGC staff, which will be followed by a discussion related to the regulations review process.

The Commission then anticipates that it will meet in executive session in accordance with G.L. c. 30A, §21(a)(3) to discuss strategy with respect to litigation related to the confidentiality of certain documents and information as discussion of the subject matter at an open meeting may have a detrimental effect on the litigating position of the Commission, and in accordance with G.L. c. 30A, §21(a)(7) to evaluate a matter relative to the Nondisclosure Agreement between the Commission and Wynn MA, LLC pursuant to G.L. c. 23K, §21(a)(7) and 205 CMR 139.02 as discussion of the matter in a public forum would frustrate the purpose of the statute, the regulation, and agreement. The public session of the Commission meeting will not reconvene at the conclusion of the executive session.
