The Office of the Massachusetts Attorney General and the Massachusetts Gaming Commission have reached a mutual decision regarding recently instituted litigation by the Cities of Boston, Revere and Somerville against the Commission challenging its decision to license a casino in Everett. The Attorney General’s office and the Commission agree that the AG’s existing criminal prosecution of several individuals associated with the sale of land in Everett for a casino is of paramount importance. It also is agreed that if the Attorney General’s Office both prosecutes the criminal case and defends the Commission in the local cities’ litigation, it may complicate the full and vigorous presentation of legal issues by both the AG’s office and the Commission in these respective matters. Therefore, Attorney General Maura Healey and the Commission have cooperatively determined that the Commission will secure private legal representation at its own non-taxpayer-funded expense to resolve matters involving the local cities’ litigation. The AG’s office will devote its attention to the criminal prosecution.
