MGC to hold Public Meetings on Untethered Category 3 Sports Wagering License Applications

WHO:                  Members of the Massachusetts Gaming Commission including Chair Cathy Judd-Stein and Commissioners Brad Hill, Jordan Maynard, Eileen O’Brien, and Nakisha Skinner

WHAT:                The MGC will hold multiple public meetings on Friday, January 6; Monday, January 9; Tuesday, January 10; Wednesday, January 11; Friday, January 13, 2023; Tuesday, January 17, 2023; Wednesday, January 18, 2023; Thursday, January 19, 2023; and Friday, January 20, 2023.

The Massachusetts Gaming Commission will hold multiple public meetings in the coming weeks regarding applications for untethered Category 3 Sports Wagering Operator Licenses.

At those meetings, the Commission will consider applications for Category 3 Sports Wagering Operator Licenses from the following entities: Bally’s Interactive, LLC, Betfair Interactive US, LLC (d/b/a FanDuel), Betr Holdings, Inc., Crown MA Gaming, LLC (DraftKings), Digital Gaming Corporation USA, and PointsBet Massachusetts, LLC. Applications will be reviewed in alphabetical order.

Each meeting will begin at 10 a.m. on its respective scheduled day, except for the meetings held on Wednesday, January 18 and Friday, January 20, which will begin at 11:30 a.m. and 11:00 a.m., respectively.

All of the upcoming meetings are expected to follow similar schedules, as detailed below.

Following Opening Remarks, a legal framework relative to the award of a sports wagering license will be presented by General Counsel Todd Grossman. The applicant will then give a presentation of its application to the Commission along with demonstrations of technology and user experience in accordance with 205 CMR 218.06(3).

Those will be followed by presentations and analysis relevant to the review and evaluation the application, which is comprised of three parts: technical components, a report on the applicant’s suitability, and a financial and economic impact analysis.

A review and evaluation of the application is then set to follow, including, but not limited to, consideration of (1) experience and expertise related to Sports Wagering, (2) economic impact and other benefits to the Commonwealth if a license is awarded, (3) proposed measures related to responsible gaming, (4) an applicant’s willingness to foster racial, ethnic, and gender diversity, equity and inclusion, (5) technology intended to be used, (6) suitability of the applicant and qualifiers, (7) other appropriate factors, and (8) the variations between the applicants as they relate to any other Sports Wagering License Applicants or licensees, and how granting any particular application, or combination of applications, would maximize overall benefits and minimize overall harms or the risk of harms to the Commonwealth.

The Commission is then expected to meet in Executive Sessions following those portions of each meeting.

There is also time reserved at the end of each meeting for other business the Chair did not reasonably anticipate at the time of this posting.
