REQUEST FOR PUBLIC COMMENT: Draft regulation amendments pertaining to adjudicatory proceedings, table games technical and equipment standards

Notice is hereby provided that in accordance with G.L. c. 30A, §2, that the Massachusetts Gaming Commission (“Commission”) will convene a public hearing for purposes of gathering comments, ideas, and information relative to a proposed new sections to 205 CMR. The proposals were developed pursuant to G.L. c. 23K, §5, as part of the Commission’s regulation promulgation process. The proposals include amendments to the following sections:
- 205 CMR 101.00: Adjudicatory Hearings, and 205 CMR 115.00: Phase 1 and New Qualifier Suitability Determination, Standards, and Procedures; 205 CMR 132.01: Discipline of a Gaming License; 205 CMR 133.00: Voluntary Self-Exclusion; 205 CMR 134.00: Licensing and Registration of Employees, Vendors, Junket Enterprises and Representatives, and Labor Organizations; 205 CMR 136.00 Sale and Distribution of Alcoholic Beverages at Gaming Establishments; 205 CMR 138.07: Internal Controls A: (Reserved); 205 CMR 152.00: Individuals Excluded From a Gaming Establishment. The proposed amendments clarify authority and ensure that all decisions in adjudicatory proceedings made by the Commission, hearing officer, and internal divisions have clear processes. And,
- 205 CMR 138.62: Payment of Table Game Progressive Payout Wagers; Supplemental Wagers Not Paid from the Table Inventory; 205 CMR 143.02: Progressive Gaming Devices; 205 CMR 146.23: Chase the Flush Table; Physical Characteristics; 205 CMR 146.58: Crazy 4 Poker Table; Physical Characteristics, and 205 CMR 146.59: Criss Cross Poker Tables; Physical Characteristics; 205 CMR 146.63: Progressive Wager Equipment. These proposed amendments outline applicable technical and equipment standards as they pertain to specific table games.

Anyone wishing to offer comment on any of the draft regulations may appear at the public hearing at the designated date and time or submit written comments. Those who wish to submit written comments on a draft regulation may do so by sending an email to mgccomments@state.ma.us with “draft regulations comment” in the subject line. Please be certain to identify in your comments the section number of the regulation on which you are commenting. Comments must be received by 4:00pm on Friday, June 8th, 2018.
